Terms of Service

Spective offers auto-renewable subscriptions to unlock Pro features. By subscribing, you agree to the following:

• Auto-renewal: Subscriptions automatically renew at the end of each billing period (monthly or annual) unless cancelled at least 24 hours before the end of the current period.
• Billing: Payment will be charged to your Apple ID or Google Play account at confirmation of purchase and on each renewal.
• Pricing: Current subscription prices are displayed in the app prior to purchase. Founding Member pricing, when offered, is locked in for the lifetime of the subscription as long as the subscription remains active and uncancelled.
• Cancellation: You may cancel your subscription anytime from your Apple ID Subscription Settings (iOS) or Google Play Subscriptions (Android). Cancellation takes effect at the end of the current billing period; no partial refunds for unused portions.
• Refunds: Refunds are handled by Apple or Google per their respective policies. Brainmonger LLC does not process refunds directly.
• Free trials: If a free trial is offered, any unused portion is forfeited when you purchase a subscription, where applicable.

You are responsible for: (a) the accuracy of inspection data you enter; (b) compliance with all applicable laws and professional licensing requirements in your jurisdiction; (c) maintaining the confidentiality of your account credentials; and (d) all activity that occurs under your account.

You agree not to: (a) reverse-engineer, decompile, or attempt to extract source code from the app; (b) resell, lease, or sublicense access to the app; (c) use the app for any unlawful purpose; (d) interfere with or disrupt the app or its servers; or (e) circumvent any access controls or subscription requirements.

Spective, including its software, design, branding, and content (excluding your inspection data), is owned by Brainmonger LLC and protected by U.S. and international copyright, trademark, and other intellectual property laws. SPECTIVE is a trademark of Brainmonger LLC.

Spective allows you to import custom inspection templates that you have created or licensed. By uploading any template file, you represent and warrant that:

• You are the original author of the template, or you hold all necessary rights, licenses, and permissions to use and import it;
• The template does not infringe on any copyright, trademark, trade secret, or other intellectual property right of any third party;
• You have not obtained the template by copying or exporting from any third-party inspection software without explicit written authorization from that software's owner.

You retain full ownership of templates you create and upload. By uploading a template, you grant Brainmonger LLC a limited, non-exclusive license solely to store and process the template for the purpose of providing the Spective service to you.

Uploading templates you do not own or have rights to use is a material breach of these Terms and may expose you to civil or criminal liability. Brainmonger LLC reserves the right to remove any template or suspend any account that we reasonably believe is in violation of this section.

You retain ownership of your inspection data, client information, photos, and reports. We process your data as described in our Privacy Policy.

SPECTIVE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the app will be uninterrupted, error-free, or that defects will be corrected.

Spective is a tool to assist inspection professionals; it does not replace professional judgment, training, or compliance with applicable codes and standards.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRAINMONGER LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF SPECTIVE. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PRIOR TWELVE (12) MONTHS, OR $50 USD, WHICHEVER IS GREATER.

We may suspend or terminate your access to Spective at any time if you violate these Terms. You may stop using Spective at any time by uninstalling the app and cancelling your subscription. Sections 6, 7, 9, 10, and 12 survive termination.

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict of law principles. Any dispute arising from these Terms or use of Spective shall be resolved in the state or federal courts located in Orange County, Florida.

If you obtained Spective from the Apple App Store, you acknowledge that these Terms are between you and Brainmonger LLC, not Apple. Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support. In the event of any failure to conform to applicable warranties, you may notify Apple, who will refund the purchase price (if any); Apple has no other warranty obligation whatsoever. Apple is a third-party beneficiary of these Terms and may enforce them against you.

We may update these Terms from time to time. Material changes will be notified via the app or via the email address on your account. Continued use after changes constitutes acceptance.
